Please read these Terms of Service carefully before using SwissTrip. By creating an account or using the service, you agree to be bound by these terms.

1. Service Description

SwissTrip (swisstrip.app) is a travel planning application for Switzerland, operated by F. Weinhappl, Switzerland. The service allows users to discover destinations, plan trip itineraries, save favourites, and interact with an AI-powered travel assistant.

SwissTrip is a planning and discovery tool. We do not sell travel products, book hotels, or act as a travel agent. Any bookings made based on information from SwissTrip are made directly with the relevant service providers.

2. Account Creation

• You must be at least 16 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and current information when registering.
• One person may not maintain more than one free account.
• You are responsible for all activity that occurs under your account.

3. Subscription Plans & Pricing

SwissTrip offers the following plans, all prices in Swiss Francs (CHF):

Prices may change with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect. All payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on the applicable billing cycle.

4. Cancellation & Refunds

• Monthly subscriptions may be cancelled at any time via your account settings.
• Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
• Annual subscriptions may be refunded within 14 days of purchase if the Pro features have not been substantially used.
• Consumer law withdrawal rights apply where mandated by law.

5. AI-Generated Content Disclaimer

SwissTrip includes an AI-powered travel assistant powered by Anthropic's Claude. Content generated by the AI assistant is provided for informational and planning purposes only.

• AI-generated itineraries, recommendations, and information may contain errors, inaccuracies, or outdated information.
• Always verify critical travel information (opening hours, prices, transport schedules, entry requirements) with official sources before travel.
• SwissTrip is not liable for decisions made based on AI-generated content.
• AI responses are not professional travel advice, legal advice, or medical advice.

6. User Responsibilities

By using SwissTrip, you agree not to:

• Use the service for any unlawful purpose or in violation of these terms.
• Attempt to gain unauthorised access to any part of the service or its underlying systems.
• Scrape, copy, or systematically extract content or data from the service.
• Use the AI assistant to generate harmful, deceptive, or abusive content.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the service in a way that could damage, disable, or impair its operation.
• Share your account credentials with others or allow multiple users to access a single account.

7. Intellectual Property

The SwissTrip application, including its design, code, editorial content, and branding, is the property of F. Weinhappl and is protected by applicable intellectual property laws.

Trip itineraries and content you create remain your own. By using the service, you grant us a limited, non-exclusive licence to store and display your content solely for the purpose of providing the service to you.

Destination photos sourced from Cloudinary are licensed from their respective rights holders and may not be downloaded or redistributed.

8. Limitation of Liability

To the fullest extent permitted by applicable law, SwissTrip and F. Weinhappl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the service.

Our total liability to you for any direct damages shall not exceed the amount you paid to us in the 12 months preceding the claim, or CHF 50, whichever is greater.

Nothing in these terms limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud.

9. Service Availability

We aim to provide a reliable service but cannot guarantee 100% uptime. We may perform maintenance, updates, or experience downtime beyond our control. Planned maintenance will be communicated in advance where possible. We are not liable for any losses arising from service interruptions.

10. Termination

You may delete your account at any time via account settings. Upon deletion, your personal data and trip data will be removed within 30 days in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms of Service, engage in fraudulent activity, or abuse the service. In cases of serious violation, termination may be immediate without prior notice. In other cases, we will provide reasonable notice.

11. Changes to These Terms

We may update these Terms of Service from time to time. Significant changes will be communicated via email or a prominent notice in the application at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.

12. Governing Law & Dispute Resolution

These Terms of Service are governed by Swiss law. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Switzerland.

For EU consumers, mandatory consumer protection provisions of your country of residence may also apply and are not affected by this choice of law clause.
